Terms of Service

Overview

These Terms of Service govern access to and use of SurveyOps. By using the service, you agree to these terms.

If you are using SurveyOps on behalf of a company, firm, or other organization, you represent that you have authority to bind that organization to these terms. In that case, "you" includes both you and that organization.

Account and Access

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

Organization administrators are responsible for managing user access, permissions, and account security within their workspace. You must promptly notify SurveyOps of any unauthorized use of your account or suspected security incident.

Acceptable Use

You agree not to misuse the service, interfere with its operation, or access it in an unauthorized manner. You are expressly prohibited from using automated systems, spiders, or crawlers to scrape data from our applications for the purpose of training machine learning or AI models.

You may not use the service to violate law, infringe the rights of others, upload malicious code, bypass security controls, interfere with other users, reverse engineer protected portions of the platform except where prohibited by law, or use the service in a way that could damage SurveyOps or its infrastructure.

Customer Data and Content

You retain ownership of your content. You grant SurveyOps the limited rights necessary to host and process that content to provide the service.

You are responsible for the accuracy, legality, and integrity of the data you upload or submit, including project records, field notes, coordinates, plats, images, deliverables, and client documents. You represent that you have the rights necessary to provide that content to SurveyOps.

SurveyOps may process customer data to operate, maintain, secure, support, and improve the service. We may also generate logs, telemetry, and aggregated or de-identified usage information for operational and product purposes, provided that such information does not identify you or your customers as individuals.

You are responsible for maintaining copies of records you consider critical. While SurveyOps may maintain backups and operational safeguards, the service is not a substitute for your own document retention, disaster recovery, or records management obligations.

Professional Responsibility

SurveyOps is an operations and workflow platform. It assists with coordination, documentation, scheduling, and record management, but it does not replace the professional judgment of licensed surveyors, field verification, legal review, title review, or compliance with applicable surveying, mapping, land use, or regulatory requirements.

You remain solely responsible for reviewing and validating all project data, field observations, calculations, legal descriptions, deliverables, client communications, and final work product before reliance or release.

AI Features and Generated Output

If SurveyOps provides AI-assisted features, generated outputs may be incomplete, inaccurate, or unsuitable for your intended use. AI-generated content is provided as a drafting or support aid only and must be independently reviewed by qualified personnel.

You are solely responsible for evaluating whether AI-assisted suggestions, summaries, classifications, or generated text are appropriate for your workflows, clients, and legal or professional obligations.

Billing and Subscriptions

Fees are billed in advance. You may cancel at any time and will retain access through the end of the billing period.

Unless otherwise stated in writing, subscriptions renew automatically for the same billing term. You authorize SurveyOps and its payment processors to charge the payment method on file for recurring fees, applicable taxes, and any authorized overages or add-on services.

Fees are non-refundable except as required by law or as expressly stated in a separate written agreement. SurveyOps may suspend access for failed payments and may change pricing on a prospective basis with reasonable prior notice.

Availability

We aim for high availability but do not guarantee uninterrupted service. Planned maintenance and unforeseen outages may occur.

SurveyOps may modify, suspend, or discontinue features from time to time. We will use reasonable efforts to avoid material disruption, but we do not guarantee that all features will remain available indefinitely.

Termination

We may suspend or terminate access if these terms are violated. You may terminate your account at any time.

Upon termination or cancellation, your right to access the service ends, except to the extent we make limited post-termination export or retrieval options available. SurveyOps may delete or de-identify customer data in accordance with its retention practices, contractual commitments, and legal obligations.

Intellectual Property

SurveyOps and its related software, interfaces, branding, documentation, and platform content are owned by SurveyOps or its licensors and are protected by applicable intellectual property laws. Except for the limited rights granted to you under these terms, SurveyOps reserves all rights in and to the service.

Disclaimer

The service is provided "as is" without warranties of any kind. To the maximum extent permitted by law, we disclaim all implied warranties.

We do not warrant that the service will be error-free, secure, or available at all times, or that data loss, corruption, or delay will never occur.

Limitation of Liability

SurveyOps will not be liable for indirect, incidental, or consequential damages arising from use of the service.

To the maximum extent permitted by law, SurveyOps' total liability arising out of or relating to the service or these terms will not exceed the amounts you paid to SurveyOps for the service during the 12 months preceding the event giving rise to the claim.

Indemnity

You agree to defend, indemnify, and hold harmless SurveyOps from claims, liabilities, damages, and expenses arising out of your use of the service, your content, or your violation of these terms or applicable law.

Governing Law

These terms are governed by the laws of the jurisdiction specified in your applicable order form or, if none is specified, the jurisdiction in which SurveyOps is organized, without regard to conflict of law rules.

Export and Compliance

You may not use or access the service in violation of export control, sanctions, or other applicable trade laws. You are responsible for ensuring that your use of the service complies with laws and regulations applicable to your business.

Changes

We may update these terms from time to time. Continued use of the service constitutes acceptance of the updated terms.
